Căn cứ pháp lý	<p> <br style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-variant-position: normal; font-variant-emoji: normal; line-height: normal; text-align: -webkit-auto; text-size-adjust: auto;" /> - Luật Đa dạng sinh học số 20/2008/QH12, được sửa đổi, bổ sung bởi Luật số 35/2018/QH14 và Luật số146/2025/QH15;</p> <p> - Nghị định số 35/2025/NĐ-CPngày 25/02/2025 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Môi trường;</p> <p> - Điều 21 Thông tư số 85/2025/TT-BNNMT ngày 31/12/2025 của Bộ trưởng Bộ Nông nghiệp và Môi trường quy định về quản lý loài nguy cấp, quý, hiếm, loài động vật rừng thông thường và thực thi Công ước về buôn bán quốc tế các loài động vật, thực vật hoang dã nguy cấp</p> <p> <br style="font-variant-numeric: normal; font-variant-east-asian: normal; font-variant-alternates: normal; font-variant-position: normal; font-variant-emoji: normal; line-height: normal; text-align: -webkit-auto; text-size-adjust: auto;" />  </p>

<p> <span style="color: rgb(30, 47, 65); font-family: Nunito, Arial; font-size: 18px; white-space-collapse: preserve-breaks;">- Bước 1: Nộp hồ sơ: Tổ chức, cá nhân nộp 01 bộ hồ sơ đến Sở Nông nghiệp và Môi trường theo cách thức trực tiếp hoặc qua môi trường điện tử hoặc qua dịch vụ bưu chính công ích hoặc dịch vụ bưu chính. </span></p> <p> <span style="color: rgb(30, 47, 65); font-family: Nunito, Arial; font-size: 18px; white-space-collapse: preserve-breaks;">- Bước 2: Kiểm tra tính hợp lệ: Sở Nông nghiệp và Môi trường kiểm tra và tiếp nhận ngay khi hồ sơ đảm bảo tính đầy đủ và hợp lệ đối với hồ sơ nộp trực tiếp; kiểm tra và tiếp nhận trong 01 ngày làm việc đối với hồ sơ nộp qua môi trường điện tử hoặc qua dịch vụ bưu chính công ích hoặc dịch vụ bưu chính, trường hợp thành phần hồ sơ không đầy đủ hoặc không hợp lệ thì trả lời bằng văn bản và nêu rõ lý do. </span></p> <p> <span style="color: rgb(30, 47, 65); font-family: Nunito, Arial; font-size: 18px; white-space-collapse: preserve-breaks;">- Bước 3: Xử lý hồ sơ: Trong thời hạn 22 ngày làm việc, kể từ ngày nhận được hồ sơ đầy đủ và hợp lệ, Sở Nông nghiệp và Môi trường trình Chủ tịch Ủy ban nhân dân cấp tỉnh thành lập Hội đồng thẩm định, tổ chức thẩm định và kiểm tra thực tế. Hội đồng thẩm định có ít nhất 07 thành viên, bao gồm: 01 Chủ tịch hội đồng là Lãnh đạo Sở Nông nghiệp và Môi trường; 01 Phó Chủ tịch hội đồng khi cần thiết; 01 Ủy viên thư ký và các ủy viên khác là đại diện của các cơ quan quản lý nhà nước cấp tỉnh về nông nghiệp và môi trường, khoa học và công nghệ; Cơ quan khoa học CITES Việt Nam và các chuyên gia có chuyên môn phù hợp; Trong thời hạn 03 ngày làm việc kể từ ngày có kết quả thẩm định, Sở Nông nghiệp và Môi trường trình Chủ tịch Ủy ban nhân dân cấp tỉnh xem xét ban hành Quyết định cấp Giấy chứng nhận Cơ sở bảo tồn đa dạng sinh học; Trong thời hạn 02 ngày làm việc kể từ ngày nhận được hồ sơ trình, Chủ tịch Ủy ban nhân dân cấp tỉnh xem xét, ban hành Quyết định cấp Giấy chứng nhận cơ sở bảo tồn đa dạng sinh học theo Mẫu số 25 Phụ lục II ban hành kèm theo Thông tư số 85/2025/TT-BNNMT ; trường hợp không cấp, thông báo bằng văn bản và nêu rõ lý do.</span></p>
