a) Tài liệu đề nghị công nhận là tài liệu lưu trữ có giá trị đặc biệt phải đáp ứng một trong các tiêu chí về nội dung quy định tại khoản 2 Điều 38 Luật Lưu trữ năm 2024 và một trong các tiêu chí về hình thức, xuất xứ quy định tại khoản 3 Điều 38 Luật Lưu trữ năm 2024, cụ thể:</div>

- Tiêu chí về nội dung bao gồm:</div>
<div>
+ Phản ánh lịch sử hình thành và phát triển của quốc gia, dân tộc, của ngành, lĩnh vực;</div>
<div>
+ Quá trình hình thành, xác lập và thực thi chủ quyền lãnh thổ Việt Nam, biên giới quốc gia;</div>
<div>
+ Công trình khoa học, sản phẩm tiêu biểu của ngành, lĩnh vực;</div>
<div>
+ Thân thế, sự nghiệp và đóng góp của cá nhân, gia đình, dòng họ tiêu biểu;</div>
<div>
+ Tài liệu lưu trữ khác có tầm quan trọng đặc biệt đối với quốc gia, dân tộc hoặc thế giới.</div>
<div>
- Tiêu chí về hình thức, xuất xứ bao gồm:</div>
<div>
+ Phương pháp, kỹ thuật trình bày đặc sắc, có tính thẩm mỹ và nghệ thuật;</div>
<div>
+ Đặc trưng, điển hình của thời kỳ lịch sử;</div>
<div>
+ Hình thành trong hoàn cảnh lịch sử đặc biệt về thời gian, địa điểm hoặc tác giả.</div>
<div>
b) Hồ sơ đề nghị công nhận tài liệu lưu trữ có giá trị đặc biệt không thuộc trường hợp đang tranh chấp về quyền sở hữu, quyền quản lý.</div>
