Sau 30 ng&agrave;y kể từ ng&agrave;y th&ocirc;ng b&aacute;o y&ecirc;u cầu bổ sung hồ sơ m&agrave; cơ sở kh&ocirc;ng bổ sung hoặc bổ sung kh&ocirc;ng đầy đủ th&igrave; hồ sơ kh&ocirc;ng c&ograve;n gi&aacute; trị. - Th&agrave;nh lập Đo&agrave;n thẩm định thực tế tại cơ sở: Trong thời hạn 15 ng&agrave;y l&agrave;m việc, kể từ ng&agrave;y c&oacute; kết quả kiểm tra hồ sơ đầy đủ, hợp lệ, cơ quan c&oacute; thẩm quyền tổ chức thẩm định thực tế tại cơ sở. Trường hợp cơ quan c&oacute; thẩm quyền cấp tr&ecirc;n ủy quyền thẩm định thực tế tại cơ sở cho cơ quan c&oacute; thẩm quyền cấp dưới th&igrave; phải c&oacute; văn bản ủy quyền. Sau khi thẩm định, cơ quan c&oacute; thẩm quyền cấp dưới phải gửi Bi&ecirc;n bản thẩm định về cơ quan thẩm quyền cấp tr&ecirc;n để l&agrave;m căn cứ cấp Giấy chứng nhận. Đo&agrave;n thẩm định thực tế tại cơ sở do cơ quan c&oacute; thẩm quyền cấp Giấy chứng nhận hoặc cơ quan được ủy quyền thẩm định ban h&agrave;nh quyết định th&agrave;nh lập. Đo&agrave;n thẩm định c&oacute; từ 03 đến 05 th&agrave;nh vi&ecirc;n, trong đ&oacute; phải c&oacute; &iacute;t nhất 02 th&agrave;nh vi&ecirc;n l&agrave;m c&ocirc;ng t&aacute;c chuy&ecirc;n m&ocirc;n về thực phẩm hoặc an to&agrave;n thực phẩm (c&oacute; bằng cấp về thực phẩm hoặc an to&agrave;n thực phẩm) hoặc quản l&yacute; về an to&agrave;n thực phẩm. Đo&agrave;n thẩm định thực tế tại cơ sở được mời chuy&ecirc;n gia độc lập c&oacute; chuy&ecirc;n m&ocirc;n ph&ugrave; hợp tham gia. Trưởng đo&agrave;n thẩm định chịu tr&aacute;ch nhiệm về kết quả thẩm định thực tế tại cơ sở. - Nội dung thẩm định thực tế tại cơ sở: + Kiểm tra t&iacute;nh thống nhất của hồ sơ đăng k&yacute; cấp Giấy chứng nhận gửi cơ quan c&oacute; thẩm quyền với hồ sơ gốc lưu tại cơ sở; + Thẩm định điều kiện an to&agrave;n thực phẩm tại cơ sở theo quy định. - Kết quả thẩm định thực tế tại cơ sở + Kết quả thẩm định phải ghi r&otilde; &ldquo;Đạt&rdquo; hoặc &ldquo;Kh&ocirc;ng đạt&rdquo; hoặc &ldquo;Chờ ho&agrave;n thiện&rdquo; v&agrave;o Bi&ecirc;n bản thẩm định điều kiện an to&agrave;n thực phẩm đối với cơ sở sản xuất thực phẩm theo Mẫu số 03a, Bi&ecirc;n bản thẩm định điều kiện an to&agrave;n thực phẩm đối với cơ sở kinh doanh thực phẩm theo Mẫu số 03b hoặc Mẫu số 03a v&agrave; Mẫu số 03b đối với cơ sở vừa sản xuất vừa kinh doanh thực phẩm theo Mục I Phụ lục ban h&agrave;nh k&egrave;m theo Nghị định 17/2020/NĐ-CP. Đối với cơ sở kinh doanh thực phẩm tổng hợp, cơ sở được cấp Giấy chứng nhận khi c&aacute;c điều kiện kinh doanh của &iacute;t nhất một nh&oacute;m sản phẩm được đ&aacute;nh gi&aacute; &ldquo;Đạt&rdquo;. C&aacute;c nh&oacute;m sản phẩm đạt y&ecirc;u cầu theo quy định sẽ được ghi v&agrave;o Giấy chứng nhận cơ sở đủ điều kiện an to&agrave;n thực phẩm. + Trường hợp &ldquo;Kh&ocirc;ng đạt&rdquo; hoặc &ldquo;Chờ ho&agrave;n thiện&rdquo; phải ghi r&otilde; l&yacute; do trong Bi&ecirc;n bản thẩm định. Trường hợp &ldquo;Chờ ho&agrave;n thiện&rdquo;, thời hạn khắc phục tối đa l&agrave; 60 ng&agrave;y kể từ ng&agrave;y c&oacute; bi&ecirc;n bản thẩm định. Sau khi đ&atilde; khắc phục theo y&ecirc;u cầu của Đo&agrave;n thẩm định, cơ sở phải nộp b&aacute;o c&aacute;o kết quả khắc phục theo Mẫu số 04 Mục I tại Phụ lục ban h&agrave;nh k&egrave;m theo Nghị định 17/2020/NĐ-CP v&agrave; nộp ph&iacute; thẩm định về cơ quan c&oacute; thẩm quyền để tổ chức thẩm định lại theo quy định tại điểm c khoản 1 Điều 13 Nghị định số 17/2020/NĐ-CP. Thời hạn thẩm định lại tối đa l&agrave; 10 ng&agrave;y l&agrave;m việc t&iacute;nh từ khi cơ quan c&oacute; thẩm quyền nhận được b&aacute;o c&aacute;o khắc phục. Sau 60 ng&agrave;y cơ sở kh&ocirc;ng nộp b&aacute;o c&aacute;o kết quả khắc phục th&igrave; hồ sơ đề nghị cấp Giấy chứng nhận cơ sở đủ điều kiện an to&agrave;n thực phẩm v&agrave; kết quả thẩm định trước đ&oacute; với kết luận &ldquo;Chờ ho&agrave;n thiện&rdquo; kh&ocirc;ng c&ograve;n gi&aacute; trị. Trường hợp kết quả thẩm định lại &ldquo;Kh&ocirc;ng đạt&rdquo; hoặc qu&aacute; thời hạn khắc phục m&agrave; cơ sở kh&ocirc;ng nộp b&aacute;o c&aacute;o kết quả khắc phục, cơ quan c&oacute; thẩm quyền th&ocirc;ng b&aacute;o bằng văn bản tới cơ quan quản l&yacute; địa phương để gi&aacute;m s&aacute;t v&agrave; y&ecirc;u cầu cơ sở kh&ocirc;ng được hoạt động cho đến khi được cấp Giấy chứng nhận. + Bi&ecirc;n bản thẩm định thực tế tại cơ sở được lập th&agrave;nh 02 bản c&oacute; gi&aacute; trị như nhau, Đo&agrave;n thẩm định giữ 01 bản v&agrave; cơ sở giữ 01 bản.</span></td> </tr> </tbody> </table> <p> &nbsp;</p>

a) Điều kiện chung</div>
<div>
1. C&aacute;c cơ sở sản xuất, kinh doanh thực phẩm thuộc đối tượng phải cấp Giấy chứng nhận cơ sở đủ điều kiện an to&agrave;n thực phẩm:</div>
<div>
C&oacute; đủ điều kiện bảo đảm an to&agrave;n thực phẩm ph&ugrave; hợp với từng loại h&igrave;nh sản xuất, kinh doanh thực phẩm theo quy định tại Mục 2, 3, 4, 5, 6 v&agrave; 7 Chương VI của Nghị định 77/2016/NĐ-CP.</div>
<div>
2. C&aacute;c cơ sở sản xuất, kinh doanh thực phẩm kh&ocirc;ng thuộc đối tượng phải cấp Giấy chứng nhận cơ sở đủ điều kiện an to&agrave;n thực phẩm:</div>
<div>
a) C&oacute; đủ điều kiện bảo đảm an to&agrave;n thực phẩm ph&ugrave; hợp với từng loại h&igrave;nh sản xuất, kinh doanh thực phẩm theo quy định của Luật An to&agrave;n thực phẩm;</div>
<div>
b) Đối tượng được quy định tại c&aacute;c điểm a, b, c, d, đ, e, g, h v&agrave; i khoản 1 Điều 12 của Nghị định số 15/2018/NĐ-CP ng&agrave;y 02 th&aacute;ng 02 năm 2018 của Ch&iacute;nh phủ quy định chi tiết thi h&agrave;nh một số điều của Luật An to&agrave;n thực phẩm:</div>
<div>
Thực hiện việc gửi bản cam kết đến cơ quan c&oacute; thẩm quyền do Ủy ban nh&acirc;n d&acirc;n cấp tỉnh ph&acirc;n cấp quản l&yacute; về an to&agrave;n thực phẩm tr&ecirc;n địa b&agrave;n.</div>
<div>
c) Đối tượng được quy định tại điểm k khoản 1 Điều 12 Nghị định số 15/2018/NĐ-CP ng&agrave;y 02 th&aacute;ng 02 năm 2018 của Ch&iacute;nh phủ quy định chi tiết thi h&agrave;nh một số điều của Luật An to&agrave;n thực phẩm:</div>
<div>
Thực hiện việc gửi bản sao Giấy chứng nhận (c&oacute; x&aacute;c nhận của cơ sở sản xuất, kinh doanh thực phẩm) theo quy định tại điểm k khoản 1 Điều 12 Nghị định số 15/2018/NĐ-CP đến cơ quan c&oacute; thẩm quyền do Ủy ban nh&acirc;n d&acirc;n cấp tỉnh ph&acirc;n cấp quản l&yacute; về an to&agrave;n thực phẩm tr&ecirc;n địa b&agrave;n.&rdquo;</div>

b) Điều kiện ri&ecirc;ng</div>
<div>
- Cơ sở sản xuất c&aacute;c sản phẩm thực phẩm c&oacute; c&ocirc;ng suất thiết kế:&nbsp;&nbsp;</div>
<div>
+ Rượu: Từ 03 triệu l&iacute;t sản phẩm/năm trở l&ecirc;n;</div>
<div>
+ Bia: Từ 50 triệu l&iacute;t sản phẩm/năm trở l&ecirc;n;</div>
<div>
+ Nước giải kh&aacute;t: Từ 20 triệu l&iacute;t sản phẩm/năm trở l&ecirc;n;</div>
<div>
+ Sữa chế biến: Từ 20 triệu l&iacute;t sản phẩm/năm trở l&ecirc;n;</div>
